Several patches have been released for XBOX 360:

I know there is a method to transfer option file to XBOX HDD (Xport/Xsata), but these patches need a flashed console, which I don't want to have.

Once the new dahsboard update allows to install pes 2009 in our HDD, could it be possible to modify these installed files in order to install these patches?.

No you can only play it if your Xbox is flashed.
